A Renaissance Jewel in the heart of Vieux-Lyon, the 5-star hotel Cour des Loges will host the AIJA Annual Antitrust Conference taking place from 3 to 5 October 2019.

During six sessions, lawyers from all over the world will have the opportunity to exchange best practices and learn more from representatives of competition authorities, economists, professors, in-house counsel and judges. Titled 'Antitrust litigation in a modern world: Competition law as a shield or a sword?', the seminar will focus on antitrust litigation in a broad sense, with sessions covering general policies reflected by new developments in national and international legal frameworks as well as practice-based insights. We will look at new developments in public and private enforcement of antitrust law through the recent ECN+ directive, and litigation strategies for plaintiffs and defendants in competition cases.

Lyon is also the city where the Lumières brothers invented cinema at the end of the 19th century and where important players of the French entertainment industry have their head offices today. Characterised by fast-evolving markets and the entry of new operators, the entertainment sector will be another topic which we will address during the seminar.

Finally, negotiation skills are key for antitrust lawyers and litigators. An interactive workshop on how to develop or improve negotiation skills will complement the academic programme.

Beside the Cour des Loges’ exceptional place, participants will also discover gastronomy with in particular wine tasting and dinner in the heart of the wineyard Domaine Ogier.

While the European public enforcement policy reinforces national competition authorities’ investigation powers and jurisdictional review through the ECN+ directive, companies are also facing growing financial risk exposure when suspected to violate antitrust rules through the development of private enforcement world-wide. In the last decade, both new rules and new factual realities forced debating relatively innovative avenues of Competition Law. By means of obvious examples, there has been undoubted (maybe also unexpected?) impact on solidly rooted leniency systems as a consequence of widespread damage claims in distinct jurisdictions. Likewise, it is also evident that digitisation is heavily challenging solid antitrust concepts such as exploitative abuses -are they possible vis-à-vis consumers and their data? (see the German Facebook case)- or some very fundamental aspects of collusion -are algorithms capable of colluding?. This panel aims at addressing these new challenges for competition law identifying three main areas of concern and trying to find answers to some very basic policy questions: Where are we going to? Where should we be going to? Do the answers match at all?

The EU Antitrust Damages Directive aimed at levelling the playing field for claimants and defendants across the Member States. Nearly three years after its implementation, marked differences between the national frameworks, however, persist and pursuing private damages claims remains complex. Understanding the practical, economic and legal difficulties is key when assessing whether to bring an antitrust damages action. Antitrust litigation practitioners from different Member States will discuss these issues in light of their experiences in their home jurisdictions in an interactive format.

Defendants in civil suits have to fight – whether they want it or not. Our panelists will discuss typical and untypical defense arguments in cartel and abuse cases. We will talk about the question of whether defendants can coordinate their defense strategies. In addition, we discuss how to calculate joint and several compensation and clarify who can ultimately be held liable for damages. A debate on manager liability and D&O insurance for cartel damages will round off our panel.
