What better place than The Hague to organise a conference on Human Rights and the growing importance of ESG in international business (and) law. We are excited to invite you to The Hague for the 2023 Half-Year May Conference of AIJA. In The Hague, ten thousand people are working every day towards a better, safer and more secure world. With the Peace Palace at the centre of it all, The Hague truly is The International City of Peace and Justice also known for the International Law, or as Former United Nations Secretary-General Boutros Boutros-Ghali called it the 'legal capital of the world’. The Hague has a deserving reputation of prestige, stature and influence. It is home to the Dutch Royal Family, the Parliament, over 160 NGOs International organisations, United Nations, 120 embassies and numerous courts such as the International Court for Arbitration, International Criminal Court, International Court of Justice.

The Hague offers a surprising and refreshing diversity. Historic and modern architecture harmoniously interlocks in the charming city centre. You might also be surprised by the city's playful side – with its beautiful 11 km long sandy beach, promenade, bars, restaurants, museums and a vibrant cultural scene, something that all the visitors love to discover. In and around The Hague you will find a vast network of organisations and initiatives in the fields of law, human rights and peace and justice, such as Clingendael – a renowned think-tank and expertise centre, NATO CIMIC Centre of Excellence, Centre for Innovation – Leiden University, The Hague Institute for Innovation of Law (HiiL) and The Hague Humanity Hub. Just to name a few.

The conference will feature three academic tracks. Taking advantage of our presence in The Hague, the first track will concentrate on the various Hague conventions. The second track will be dedicated to Arbitration, Litigation & Human Rights in view of the special place that The Hague holds in this regard. The third track will be dedicated to the Social and Governance aspect of ESG as the follow up on the discussions undertaken during the Half-Year Conference in Edinburgh in 2022.

In addition to a great academic programme in the new house for the arts, events, education and cultural encounter (Amare), the Organising Committee has arranged a social programme that will show you the surprising and refreshing diversity of The Hague. Not only will you get to dine and dance at the beach club, but you will also experience a fabulous gala dinner in the Kunstmuseum (home of the famous Victory Boogie Woogie by Piet Mondriaan), see the homes and experience the home cooking of local legal practitioners and you might even get to visit the Peace Palace (in which the International Court of Justice and the Permanent Court of Arbitration are housed).

ACADEMIC PROGRAMME OVERVIEW

This is the first time in history of AIJA to hold a conference in The Hague, the place which has a great importance for all international lawyers due to the Hague conventions and instruments. The Hague Track will discuss various Hague conventions and instruments of the Hague Conference on Private International Law. We will focus on practical impacts of them on the day-to-day work of lawyers and recent related updates and news.

Disputes involving human rights have always been of crucial importance in view of the interests at stake. Dealing with such disputes as a dispute resolution practitioner can, however, prove difficult in view of the particularities that may arise in this context. This academic track, which shall be particularly relevant for members of the International Arbitration Commission and of the Litigation Commission, will focus on various types of human rights disputes that lawyers may encounter nowadays. Procedural tactics, practical aspects as well as issues on the merits will be discussed in order to determine what challenges dispute resolution practitioners are facing in their practice today. Building upon these findings, we will try to identify areas of improvement and how to make sure that lawyers handle human rights disputes in the most efficient manner in the future.

This track continues where the Edinburgh Half-Year Conference in November 2022 left off.
ESG (Environmental, Social and Governance) is often considered as a synonym for matters of climate change and the environment. However, ESG is increasingly at the top of the corporate agenda and carries a broad spectrum of topics including corporate governance, human rights, supply chain issues and employee relations. The ESG track will seek to explore the multidimensional aspects of ESG with particular focus on the Social and Governance pillars, sharing insights and practical guidance on key emerging trends and opportunities for international lawyers to address the rising demand for ESG services as global businesses and the investment community shifts to a green economy.

Women today make up half the legal profession with an rising trend of mid-life women joining the global labour force. The number of Employment Tribunal claims in the UK alone that reference the menopause have nearly doubled in the last year. We would undoubtedly stand to benefit from gaining a better understanding of women’s health as it journeys through different stages of the menopause.
In today’s modern age of great digital advancements and diversification of culture, menopause is little understood by those who go through it and by their nearest and dearest. Menopause is commonly considered as a taboo subject and carries a stigma whenever it is brought up for discussion.
As lawyers, you will interact frequently with menopausal women, be they your colleagues, managers, friends and family or even your clients. The hesitancy to openly discuss menopause must change – we need to increase awareness and understanding of menopause, and how it affects everyone. Indeed, have you thought about how the law treats menopausal women in various legal contexts such as in family law or employment law? Have you ever considered the menopause to be a factor in your legal cases?
This workshop, a follow on from the successful reproductive health challenges workshop in Edinburgh, will guide you through an understanding of what the menopause is, how you can better support your colleagues and family who are going through this life stage, and how to better advise your clients where the menopause may be a significant factor. This workshop is not to be missed.

SPOTLIGHT ON HUMAN RIGHTS

Have you ever run for human rights with AIJA? Be ready to show your renewed support and go beyond. As the amazing city of The Hague will give us the possibility to swim, cycle and run over various distances, AIJA will adapt its traditional Run for Human Rights to AIJA Triathlon for Human Rights on the occasion of the Half-Year May Conference. 
It does not mean that you must do it all! You can also participate in one or two part of this challenge, either run, swim and/or bike. Remember that we do sport for a good cause: raising awareness about human rights.

Human Rights are not only relevant for activists, pro bono attorneys, etc. Human Rights are becoming increasingly relevant to businesses and their lawyers too. Not just for lawyers who practice privacy laws or litigate about freedom of speech, but for all lawyers. Nowadays businesses face serious reputation and liability risks when they infringe human rights or allow their business partners to do so. With ESG requirements being included in laws more and more the compliance angle of this is becoming more relevant as well. 
We want to discuss this with you: AIJA members, during a round-table session. Let’s share experiences, thoughts and worries and learn from each other!
The meeting will take place on Friday 26 May (14:00-15:00 CEST) at Amare Convention Centre. 

During the session, the keynote speakers will tell us about their experiences at international criminal law institutions such as the International Criminal Court, Yugoslavia Tribunal and Kosovo Tribunal. We will talk about how these organisations work, the lessons learned from the past and the problems that may arise when combatting crimes against humanity and war crimes. We will also discuss the role such organisations can play in combatting those types of crimes currently being committed in the world. Will there be a Ukraine Tribunal in the future? Or a general tribunal focussed on the crime of aggression?

This session will take place in the Peace Palace on Saturday 27 May (10:00-13:30 CEST).

The Peace Palace located in The Hague serves as international law administrative building. The building opened its doors in 1912, as its construction was initiated after the First Hague Peace Conference in 1899 discussing disarmament, international jurisdiction and arbitration, with the aim of hosting the Permanent Court of Arbitration. Currently, The Peace Palace houses such important institutions as the United Nations International Court of Justice and the Permanent Court of Arbitration. The place is, as well a home to the Hague Academy of International Law. Both courts and the Academy have at their disposal the Peace Palace Library holding an extensive collection of international law papers.

After the session guided tours will be offered to Conference delegates.

You will learn last minute tricks and tips to enhance the professional delivery and impact of your presentation and already prepared content. The course will be a hands-on session where some of you will also have the chance to rehearse parts of your respective speeches (max. 2 minutes, subject to the number of participants) in front of a live audience consisting of fellow speakers and moderators. The international conventions on sale adopted in the past century were among the most successful, leading to the creation of a single body of law, approved by the vast majority of states, even of completely different legal systems.
In recent decades, however, this process seems to have stalled, and unification has continued in a jeopardized manner, by macro-areas and without a single body of law.
In this panel, we will consider how major international distribution conventions govern recent events that have severely stressed supply chains around the world, and how these conventions have been interpreted in different legal systems.

The 1985 Hague Convention on the Law Applicable to Trusts and on their Recognition entered into force in 13 countries. Its influence however has been far greater since other countries choose to implement the common law trust concept of the Convention into their national conflict of laws. Other jurisdictions created fiduciary arrangements more or less similar to the trust.

Contrary to common law jurisdictions where the trust is widely used and has a long history, both inter vivos and testamentary, in civil law jurisdictions the trust’s image is clouded: from a historical perspective, Napoleon already discouraged the concentration of wealth over generations in the Code Civil. Today, the trust is often framed as a money-laundering (‘AML’) tool, used by criminals and key persons of sanctioned regimes.

From a tax perspective, setting aside money in an overseas trust raises income tax and inheritance tax concerns. Jurisdictions strive to attribute the income of the trust’s assets to their domestic settlors and beneficiaries, rather than to the trust itself or its elusive trustees. From an inheritance tax perspective the estate or the beneficiaries are also the targeted taxpayers.

Hence the importance of identifying the beneficiaries of a trust for AML and tax purposes through ultimate beneficial owner rules and international exchange of information agreements.

This panel will deal with the question why (not) to advise a trust to individuals and families in an international situation?

Women today make up half the legal profession with an rising trend of mid-life women joining the global labour force. The number of Employment Tribunal claims in the UK alone that reference the menopause have nearly doubled in the last year*. We would undoubtedly stand to benefit from gaining a better understanding of women’s health as it journeys through different stages of the menopause.
In today’s modern age of great digital advancements and diversification of culture, menopause is little understood by those who go through it and by their nearest and dearest. Menopause is commonly considered as a taboo subject and carries a stigma whenever it is brought up for discussion.
As lawyers, you will interact frequently with menopausal women, be they your colleagues, managers, friends and family or even your clients. The hesitancy to openly discuss menopause must change – we need to increase awareness and understanding of menopause, and how it affects everyone. Indeed, have you thought about how the law treats menopausal women in various legal contexts such as in family law or employment law? Have you ever considered the menopause to be a factor in your legal cases?
This workshop, a follow on from the successful reproductive health challenges workshop in Edinburgh, will guide you through an understanding of what the menopause is, how you can better support your colleagues and family who are going through this life stage, and how to better advise your clients where the menopause may be a significant factor.

During the session, the keynote speakers will tell us about their experiences at international criminal law institutions such as the International Criminal Court, Yugoslavia Tribunal and Kosovo Tribunal. We will talk about how these organisations work, the lessons learned from the past and the problems that may arise when combatting crimes against humanity and war crimes. We will also discuss the role such organisations can play in combatting those types of crimes currently being committed in the world. Will there be a Ukraine Tribunal in the future? Or a general tribunal focussed on the crime of aggression?

Please note that in-house counsel registrations are subject to review and confirmation by AIJA. AIJA considers in-house counsel professionals who hold a university degree in law allowing access to a bar association and practicing law as an in-house counsel in private, public, or non-profit companies, institutions or organisations. Please note that in-house counsel who are at the same time active as fee-earning lawyers or consultants are not eligible to the discounted in-house counsel fee.

Optimum accessibility
Amare occupies a central location in The Hague with perfect accessibility. The city’s main railway station (Centraal Station) and the A12/A4/A44/A13 motorways are a stone’s throw away. Four to eight trains depart for Schiphol, Amsterdam and Rotterdam every hour. There are trams and bus stops in front of the building, and underneath Amare is a bicycle parking with a capacity of 1500 and a parking garage with 700 places.

Accommodation
Many three and four-star hotels can be found the direct surrounding area, guaranteeing a comfortable stay. Check AIJA’s recommendations which will soon be provided below.

Surrounding area
For those who want to catch some fresh sea air on the pier of Scheveningen after a convention or event, the tram will get you there in just a few stops. If, on the other hand, you would prefer to see Vermeer’s Girl with a Pearl Earring or Mondrian’s Victory Boogie Woogie, the Mauritshuis and the Kunstmuseum are within walking and cycling distance.

HOW TO REACH THE HAGUE 

AIJA, its Sustainability Board and the Organising Committee encourage everyone who plan to attend the Half-Year May Conference in the Hague to participate in and contribute to the sustainability around this event by using trains as their main means of transport.

We encourage participants coming to the Netherlands from the neighboring countries, in particular, Austria, Belgium, France, Germany, Luxembourg, Switzerland, the UK to contact the AIJA Representatives in the respective country for more information on #AIJATrains or simply hop on already pre-selected train connections (check out here).

To those who need to arrive by plane to Rotterdam or Schiphol Airport, we suggest taking a train connection to The Hague Central C/S (a brief transfer of 20 to 40 minutes may be needed to reach the direct train to The Hague Central).

To the extent necessary for the execution of their respective tasks, our subcontractors in charge of our seminar organisation, our IT infrastructure, our management, the production and maintenance of our website and extranet, are likely to gain access to your data from time to time. Their servers are located in the European Union.

Data relating to your participation in the event shall be stored for a period of 10 years. We are obliged to archive billing data until the end of the period required for our tax and accounting obligations, i.e. for 7 full tax years.
