We all miss our AIJA gatherings, but we are happy to invite you to the virtual half-day Litigation Commission Day on 22 October 2020.

Although our first Annual Litigation Conference is postponed, we will show you a glimpse of what is brewing in the litigation arena during our Commissions Month:

  • Participation of two distinguished jurists
  • Discussions of evidentiary and litigation funding issues
  • Two social programmes

Here is an overview of the two sessions that will be held during the Litigation Commission Day. For more details on the schedule and the speakers, please go to the programme section of this page.

1. Evidence gathering in high-stake international commercial litigation: there is the law and there are the facts and there is little chance of success in the law when the facts are not in evidence.

In complex, high-stakes, commercial cases, the issue becomes even more crucial because the litigation oftentimes plays out in different jurisdictions with their own unique approaches to the treatment and admission of evidence. This first session will feature distinguished jurists including a Judge from the Netherlands Commercial Court and Judge Wiest, vice-president of the international chamber of the Paris commercial court. 

2. How to secure your fighting fund: proving and substantiating complex high stake commercial cases brings high financial risks for your client. The second session will focus on ways in which clients can secure a fighting fund, including harnessing third party funding for complex and cross-border proceedings. The panel will include a litigation funder, a broker and two attorneys from different jurisdictions who will give profound insight from various perspectives. They will tackle i.a. various kinds of third party funding, how to best approach a funder or how to align and work with a funder.
